NICHOLAS ROSINIA is a Partner at Edelson PC and leads the Firm’s Trial Group. Nick is a first–chair trial lawyer with a national practice focusing on significant cases of first impression. Nick has served as lead counsel or co-lead counsel in trials and arbitrations around the country, and has secured hundreds of millions of dollars in verdicts, judgments and settlements for his clients.
- James v. PacifiCorp, No. 20-CV-33885 (Mult. Co. Cir. Ct.): Nick represents thousands of survivors of the 2020 Labor Day Fires in Oregon. Trials to date have included the following:*
- Nick served as co-lead counsel in a first-of-its-kind class-action liability trial. Following seven weeks of trial, the jury found the utility company—Berkshire Hathaway-owned PacifiCorp—liable to an entire class of fire survivors. The jury awarded more than $94 million in damages to the 17 class representatives and imposed punitive damages for the entire class, paving the way for potentially billions of dollars for the class. This was the first known jury verdict holding a utility provider accountable for a wildfire.
- For their victory and work on these cases, Nick and his team have twice been named “Legal Lions” by Law360, were awarded CVN’s 2023 “Most Impressive Plaintiff’s Verdict,” and were honored to receive Law.com’s 2024 Trial Strategy Innovation Award.
- Since the liability finding, Nick has served as lead counsel or co-lead counsel in five consolidated damage trials for class members, securing verdicts and judgments of $84.2 million, $42.4 million, $49.7 million, $91 million, and $21.4 million. In total, 20 damages-only trials have proceeded with verdicts now exceeding $1 billion.
- Nick served as co-lead counsel in a first-of-its-kind class-action liability trial. - Ethylene Oxide Litigation: Nick represents hundreds of cancer survivors and victims in litigation against ethylene oxide and medical device sterilizers around the country. In addition to helping secure hundreds of millions of dollars in settlements, Nick has served as lead or co-lead counsel in a four-week bellwether trial in Cook County, Ill. (following a mistrial when a juror departed during deliberations, the parties reached a confidential resolution), a six-week bellwether trial in Jefferson County, Colo., and a four-week bellwether trial in a western state (for which the case resolved the night before closing arguments).
- Social Media Litigation: Nick and his team currently serve as trial counsel to a number of state attorneys’ general in cases against Meta and Tik Tok alleging harm to minors from the use of social media, with multiple trials set for fall 2026 and into 2027.
- Doty et al. v. ADT, LLC et. al., Nos. 20-cv-60972 & 21-cv-80645 (S.D. Fla.); Bryant et al. v. ADT, LLC, No. 21-cv-82359 (S.D. Fla.); ADT, LLC v. Dorsey et al., No. 22-cv-00643 (N.D. Tex.). Nick served as trial counsel to dozens of families pursuing home security company ADT in courts and through arbitration for a flaw in ADT’s flagship “smart home” security system that allowed an ADT technician to surreptitiously watch customers and their families through their indoor ADT security cameras. After litigating across numerous states and venues, the cases resolved on the eve of the first trial.
- Prior to joining Edelson, Nick also tried cases at two prominent, international law firms, including the following:
- Allianz Global Risks U.S. Ins. Co., et al. v. ACE Prop. & Cas. Ins. Co., et al., 1204-04552, (Multnomah County Circuit Court): Served as trial counsel to an insurance carrier in a multi-week bench trial proving the existence of lost insurance policies. Secured judgment as to all policies.
- Following that trial, Nick successfully represented the carrier in a six-week jury trial seeking contribution from other insurance carriers for hundreds of millions of dollars in asbestos, Superfund and corporate succession liabilities.
- Served as trial counsel to a personal lines insurance carrier in a successful, multi-week confidential arbitration seeking reinsurance recovery for ice dam losses.
- Served as trial counsel to multinational insurance carrier in a successful, multi-week confidential arbitration arising out of a dispute with historical reinsurer.
