Consumer Fraud

Our litigation teams have prosecuted some of the most cutting edge consumer class actions in the country. As a result, we have been recognized as “Elite Trial Lawyers” in the area of Consumer Protection (The National Law Journal, May 2019), a “Plaintiffs Class Action powerhouse” (Law360, November 2015) and our founder has been called a “Titan of the Plaintiff’s Bar” (Law360, October 2014). We “[have] taken on some of the biggest companies and law firms in the world and [have] had success where others have not” (Law 360).

Our settlements on behalf of consumers nationwide are collectively valued at over $1 billion.

Representative Cases

 

Represent the parents of youth volleyball players in a certified class action lawsuit against Sports Performance Volleyball Club, as well as its owners. The complaint alleges that the defendants concealed past sexual abuse with underage players. Mullen v. GLV, Inc., et al., No. 18-cv-1465 (N.D. Ill.).

Having secured a watershed Ninth Circuit victory for consumers in Kater v. Churchill Downs Inc., 886 F.3d 784 (9th Cir. 2018), we are now pursuing consumer claims against more than a dozen gambling companies for allegedly profiting off of illegal internet casinos. In the wake of that decision, we have won numerous substantive and procedural victories in the trial courts. See, e.g., Benson v. Double Down Interactive, LLC, No. 18-cv-00525, 2018 WL 5921062 (W.D. Wash. Nov. 13, 2018) (motion to compel arbitration denied); Wilson v. Huuuge, Inc., No. 3:18-cv-05276, 2018 WL 5921019 (W.D. Wash. Nov. 13, 2018) (same); and Kater v. Churchill Downs Downs Inc., No. 15-cv-00612, 2018 WL 5734656 (same); Fife v. Sci. Games Corp., No. 18-cv-00565, 2018 WL 6620485 (W.D. Wash. Dec. 18, 2018) (motion to dismiss denied), Wilson v. PTT, LLC, No. 18-cv-05275, 2018 WL 6591621 (W.D. Wash. Dec. 14, 2018) (same), and Wilson v. Playtika, Ltd., No. 18-cv-05277, 2018 WL 6065658 (W.D. Wash. Nov. 20, 2018) (same).Following these victories, we were the only firm named as “Elite Trial Lawyers” in the Gaming Law category (The National Law Journal, May 2019).

At the forefront of class action litigation in the aftermath of federal bailouts of the banks, winning the first federal appellate decision in the country recognizing the right of borrowers to enforce HAMP trial plans under state law, Wigod v. Wells Fargo Bank, N.A., 673 F.3d 547, 586 (7th Cir. 2012), and securing settlements that restored billions of dollars in credit to borrowers. See, e.g., In re JP Morgan Chase Bank Home Equity Line of Credit Litig., No. 10-cv-3647 (N.D. Ill.) (restoring between $3.2 billion and $4.7 billion in credit to the class); Hamilton v. Wells Fargo BankN.A., No. 09-cv-04152-CW (N.D. Cal.) (restoring access to over $1 billion in credit); In re Citibank HELOC Reduction Litig., No. 09-cv-0350-MMC (N.D. Cal.) (restoring up to $653,920,000 worth of credit to affected borrowers).

Led class actions against the wireless industry—including cases against AT&T Wireless, T-Mobile, Sprint, Verizon and others—that ultimately secured more than $100 million in relief for wireless subscribers after they were fraudulently charged for unauthorized mobile content products and services.

Lead counsel in settlement that secured $30 million in relief and resolved the “Thomas the Tank Engine” lead paint recall cases, see Barrett v. RC2 Corp., No. 07 CH 20924 (Cir. Ct. Cook Cnty., Ill.), as well as a $32 million settlement involving the largest pet food recall in the history of the United States and Canada, see In re Pet Food Product Liability Litigation, No. 07-2867 (D.N.J.).
