EVE-LYNN RAPP is the Managing Partner of Edelson PC’s Boulder Office, where she focuses her practice on a wide range of consumer class and mass actions, as well as government enforcement cases, including matters on behalf of various Attorneys General and municipalities and counties across the country. Eve has been appointed class counsel or led the litigation efforts in dozens of matters and has recovered or secured judgments of over a billion dollars for her clients.

  • In re Marshall Fire (Boulder County, Colorado) (Leadership Committee): representing hundreds of individuals who lost their homes and businesses in the 2021 Marshall Fire.
  • Various Ethylene Oxide (“EtO”) matters: representing hundreds of individuals alleging their cancers were wrongfully caused by EtO emissions across various jurisdictions in Colorado, Illinois, Georgia, and Pennsylvania, and specifically leading the team’s expert strategy and litigation efforts.
  • Various PFAS matters: representing various Attorneys Generals and other public clients in their investigations and litigation into contamination and exposure issues resulting from a “forever chemical,” commonly referred to as PFAS, which has allegedly led to serious health issues, including cancer.
  • In re: Marriott International, Inc., Customer Data Security Breach Litigation, MDL 2879 (D. Md.): lead outside counsel for the City of Chicago in the Marriott data breach litigation, which seeks to hold the hotel giant accountable for a massive data breach where attackers stole the personal data of up to 383 million guests—including over 5 million unencrypted passport numbers. The City has successfully defeated Marriott’s motion to dismiss, two summary judgment motions, and Marriott’s Daubert challenges, amongst others.
  • In re: Kia Hyundai Vehicle Theft Marketing, Sales Practices, and Products Liability Litigation, MDL 3052 (C.D. Cal.): outside counsel for the City of Chicago in litigation alleging that Kia and Hyundai failed to include industry-standard engine immobilizers in multiple models of their vehicles, resulting in a steep rise in vehicle thefts, reckless driving, and a wide array of related violent crimes in the Chicago area.
  • Amans v. Tesla, Inc., No. 3:21-cv-03577 (N.D. Cal.) (Lead Counsel): representing thousands of individuals alleging that Tesla wrongly increased the price of their solar roof contracts. She recently achieved preliminary approval of a multi-million-dollar cash settlement that has additionally already resulted in over one hundred million dollars in solar roof price reversals. In many instances, individual class members are expected to recover tens of thousands of dollars each.
  • Led and resolved a case against a well-known national fitness facility for misrepresenting its “lifetime memberships,” resulting in over $25 million dollars of relief to the class. In re 24Hour Fitness Prepaid Memberships Litigation, No. 4:16-cv-01668 (N.D. Cal.).
  • Led or helped to lead approximately 40 Telephone Consumer Protection Act (“TCPA”) class actions, including Wakefield v. ViSalus, Inc., No. 15-cv-01857 (D. Or.), where, as Class Counsel, Eve led and coordinated Edelson’s litigation efforts, achieved certification of an adversarial TCPA class, and paved the way to a $925 million jury verdict. She also led Edelson’s efforts in Birchmeier v. Caribbean Cruise Line, Inc., No. 12-cv-04069 (N.D. Ill.), where, after obtaining class certification and partial summary judgment, she secured a $76 million settlement—the then largest ever for a TCPA case. The Parties reached a deal in that case four days before trial.
  • Lead counsel in one of the few “Do Not Call” TCPA cases to settle, resulting in a multi-million-dollar settlement and affording class members with as much as $5,000. Kran v. Hearst Communications, Inc., No. 15-cv-02058 (D. Minn.). She has also prosecuted TCPA cases on an individual basis in arbitrations, winning multiple six-figure settlements.
  • Led and obtained a $5 million (CAD) settlement that afforded individual class members over $100 in relief in one of the first “Internet of Things” cases under the Federal Wire Tap Act, against a company collecting highly sensitive personal information from consumers. N.P. v. Standard Innovations Corp., No. 16-cv-8655 (N.D. Ill.).
  • Represented and achieved landmark seven-figure settlement on behalf of the City of Chicago in the Equifax data breach litigation. In re Equifax, Inc., Customer Data Security Breach Litigation, MDL No. 2800 (N.D. Ga.).
  • Successfully led a number of employment class actions involving claims of overtime, recently reaching a settlement against a cellular tower company, which netted class members between $10,000 and $20,000 per person.
  • From 2015-2019, Eve was selected as an Illinois Emerging Lawyer by Leading Lawyers.
  • Chair of the San Francisco Bar Association’s Cybersecurity and Privacy Section and an active member of the California Lawyers Association Privacy Subcommittee.
  • Eve has also devoted a significant amount of time to the Chicago Lawyers’ Committee for Civil Rights Under Law’s Settlement Assistance Project where she represented a number of pro bono clients for settlement purposes.

Eve received her J.D. from Loyola University of Chicago-School of Law, graduating cum laude, with a Certificate in Trial Advocacy. During law school, she was an Associate Editor of Loyola’s International Law Review and externed as a “711” at both the Cook County State’s Attorney’s Office and for Cook County Commissioner Larry Suffredin. Eve also clerked for both civil and criminal judges (the Honorable Judge Yvonne Lewis and the Honorable Plummer Lott) in the Supreme Court of New York. Eve graduated from the University of Colorado, Boulder, with distinction and Phi Beta Kappa honors, receiving a B.A. in Political Science.
