In his class action practice, Todd is routinely appointed by courts nationwide to serve as class counsel in major class action cases of first impression. For example, in recent years, Todd has led all aspects of trial-level litigation in a group of seven related cases in the Western District of Washington alleging the novel theory that so-called “social casinos” are actually illegal gambling. In the nearly four years since the firm obtained a ruling from the Ninth Circuit holding that social casinos are governed by Washington gamblign laws, Todd has successfully briefed and argued a wide range of issues before the district court including motions to dismiss, motions to compel arbitration, and motions for class certification and preliminary injunctions. The majority of these cases have now settled, generating $225 million in cash settlements for consumers nationwide, with damages-adjusted claims rates of 15%-33% and class members recovering up to hundreds of thousands of dollars. The largest of the remaining cases, which is pending nationwide class certification, is set for trial in 2022.
Todd was also recently appointed as Law and Briefing counsel in a trio of MDLs alleging that Facebook, Apple, and Google are all liable for illegally profiting from social casino games.
